The court date for a Phoenix police officer charged with drunk driving has been rescheduled for September. The DUI suspect, Seth Castillo, failed to appear at his hearing last Friday, which resulted in the judge issuing an arrest warrant for Castillo.

His criminal defense attorney managed to change the judge's mind about the warrant because Castillo allegedly was not properly informed by his legal support that there was any court date set for him to attend last week.

This Arizona DUI case has been a bumpy ride for both Castillo and Gilbert police. Castillo and his defense attorney are not taking the DUI charges, and the way the suspect was treated at the time of arrest, lightly.

While Castillo's blood alcohol content level of 0.173 at the time of arrest isn't being denied, Castillo is accusing the officers who arrested him for using excessive force on him during the incident. The officers used a Taser gun on Castillo when they reportedly believed he was going for a weapon.

Not only does Castillo think that the officers were out of line when using the Taser, but he is suing the department for $500,000 in damages for hurting his reputation as an officer of the law and for conducting an unlawful search and seizure.

Despite the pending case and investigation involving Castillo, he is still working for the police department. How his job will be affected depends on the outcome of the DUI case and investigation.
