The violence of the shooting in Tucson is still weighing on everyone's minds. Debates regarding gun laws and heated bipartisan politics have taken over the media outlets. And, according to a recent case, the worry about alleged violence-promoting speech has had an impact on one Arizona case between two competing businessmen.

It is important to know that the individuals in the case compete for sponsors in each of their careers, a point that played a large role in an Arizona judge's recent decision to grant a permanent restraining order against one party. Why was the restraining order requested?
The Greeley Tribune reports that the man who sought the restraining order feared for his physical safety due to an alleged threat made by the defendant. He claims that the competitor left him voicemails suggesting that they have a "shoot-out over sponsors." The messages apparently put the man in fear for his safety, and last Friday, the judge presiding over the case agreed that the fear was warranted.
Said the judge in his ruling, "When someone says there will be a shoot-out, it is an implied threat of violence." In trying to justify why he wanted the restraining order, the man brought up the recent shooting involving Giffords and how that case confirmed for him that he should take legal action based on his fear.
But the defendant insists that he never intended to physically harm or threat his competitor. He says, "There has never been a threat, and there never will be a threat." His word choice, he admits, was unwise, but he never intended to have any violent interaction with anyone.
Despite the defendant's argument, the judge has permanently ordered that he keep at least a 100-yard distance from his competitor, including his home and business. Also, the defendant has lost his right to have a conceal and carry permit in the state.
Reports note that the defendant plans to appeal the decision.
