Oliver J. Miller spent several years of his basketball career with the Phoenix Suns, competing at the highest levels of the sport. But, the former NBA player, now 41, is confronting new legal challenges that could make his days on the court seem like a cakewalk.

On February 3, Miller was sentenced for his role in an alleged assault that took place last spring. Purportedly, a family argument had erupted during a cookout in which Miller and his girlfriend were participating. According to prosecutors, the argument culminated in Miller striking his girlfriend's brother in the head with a pistol, leaving a wound that took 11 staples to close.

Following the incident, Miller was charged with first-degree assault and carrying a handgun. He pleaded guilty in the fall. At sentencing in February, the judge handed down a five-year prison term. However, all but one year of the sentence was suspended, and the judge recommended work release. Under the current terms of his sentence, five years of probation will follow Miller's incarceration.

For his part, Miller apologized for his actions to the sentencing judge, and said he is "just a man protecting the people I love." Miller's girlfriend apparently agreed, saying she would help Miller get back on his feet once he is released.

According to Miller's attorney, the former NBA star intends to return to Arizona to be with his family. Miller's lawyer plans to ask the judge to amend the outcome to probation and allow Miller to complete his sentence in Arizona.
